Terms of Participation in Tourist Events of Horyzont Travel
These Terms of Participation define the rules for participation in tourist events organized by Horyzont Travel. Please read the following terms carefully before making a reservation.
1. Definitions
- Organizer: Horyzont Travel, ul. Grójecka 40, 02-320 Warsaw.
- Participant: A natural or legal person who has concluded an agreement with the Organizer to participate in a tourist event.
- Tourist Event: An organized tourist service offered by the Organizer, including at least two different tourist services (e.g. transport and accommodation).
- Agreement: An agreement to participate in a tourist event concluded between the Organizer and the Participant.
2. Reservation and Conclusion of the Agreement
- A tourist event can be booked online on the website crafterhold.com, by phone at +48 22 654 91 82 or in person at the Organizer’s office.
- The reservation becomes binding after its confirmation by the Organizer and payment of an advance payment in the amount specified in the offer.
- The Agreement is concluded when the Participant receives a booking confirmation from the Organizer.
3. Payments
- The Participant is obliged to pay an advance payment in the amount specified in the offer within the time limit indicated by the Organizer.
- The remaining amount due for the tourist event should be paid within the time limit specified in the booking confirmation, no later than 30 days before the date of commencement of the event, unless otherwise agreed.
- Payments can be made by bank transfer to the Organizer’s account, by payment card or in cash at the Organizer’s office.
- In the event of late payment, the Organizer has the right to cancel the reservation while retaining the right to deduct handling fees.
4. Price of the Tourist Event
- The price of the tourist event includes the services specified in the offer.
- The price does not include, unless expressly stated otherwise, visa fees, additional insurance, optional excursions, alcoholic beverages, meals not included in the program and the Participant’s personal expenses.
- The Organizer reserves the right to change the price of the tourist event in the event of an increase in transport costs, airport fees, fuel fees, exchange rates or other official fees. The price change may take place no later than 20 days before the date of commencement of the event. The Participant will be informed immediately about the price change.
- In the event of a price increase of more than 8%, the Participant has the right to withdraw from the Agreement without incurring costs.
5. Changes and Cancellation of the Tourist Event
- The Organizer reserves the right to change the program of the tourist event for reasons beyond the Organizer’s control (e.g. weather conditions, decisions of local authorities, force majeure). In such a case, the Organizer undertakes to offer the Participant substitute services of comparable value.
- The Organizer has the right to cancel the tourist event due to insufficient number of Participants (the minimum number of Participants is specified in the offer) or due to force majeure. In such a case, the Participant is entitled to a refund of all funds paid.
- The Participant has the right to withdraw from the Agreement at any time. In the event of withdrawal from the Agreement, the Participant is obliged to pay the withdrawal costs, which depend on the date of withdrawal and are specified in the table of handling fees.
6. Organizer’s Liability
- The Organizer is liable for the proper performance of the Agreement, except in cases where non-performance or improper performance of the Agreement is caused by:
- Action or omission of the Participant.
- Action or omission of third parties, not related to the performance of services provided for in the Agreement, which could not be foreseen or avoided.
- Force majeure.
- The Organizer is not liable for loss, damage or theft of the Participant’s luggage, unless the damage was caused by the Organizer’s fault.
- The Organizer’s liability is limited to twice the price of the tourist event.
7. Complaints
- The Participant has the right to lodge a complaint in the event of finding inconsistencies between the services and the Agreement.
- The complaint should be submitted in writing within 30 days from the date of completion of the tourist event.
- The Organizer undertakes to consider the complaint within 30 days from the date of its receipt.
8. Insurance
- The Participant is obliged to have valid travel insurance covering medical expenses, consequences of accidents and civil liability.
- The Organizer offers the possibility of purchasing travel insurance through cooperating insurance companies.
9. Personal Data Protection
- The Organizer processes the personal data of Participants in accordance with the Privacy Policy available on the website crafterhold.com.
10. Final Provisions
- In matters not covered by these Terms of Participation, the provisions of the Civil Code and the Act on Tourist Services shall apply.
- Any disputes arising from the Agreement shall be resolved by the competent common court.
- These Terms of Participation come into force on the date of their publication on the website crafterhold.com.
